O R D E R
This writ petition has been filed restraining the respondents 2 and 3 from disbursing the Award amount in favour of the 4th respondent.
2.The grievance of the petitioners is that there is a title dispute between the petitioners and 4th respondent in respect of the property acquired by the respondent and the petitioners filed a suit in O.S.No.225 of 2018, against the 4th respondent seeking declaration before the District Munsif Court, Sriperumpudhur. Pending the title dispute, now the respondents 2 and 3 taking steps to pay the compensation amount in favour of the 4th respondent. Hence, the present writ petition is filed.
3.Today, when the matter is taken up for hearing, the learned counsel appearing for the 4th respondent admitted the fact that the dispute existing between the petitioners and 4th respondent, and a civil suit is also pending before the Civil Court. The learned counsel further submitted that the matter may be referred to the concerned authority under Section 3(H)(4) of the National High Ways Act for apportionment of compensation.
The learned counsel appearing for the petitioners also has no objection for the same.
4.Considering the fact that now the Award has been passed, the second respondent is directed to refer the matter before the competent authority under Section 3(H)(4) of the National High Ways Act within a period of four weeks from the date of receipt of a copy of this order. 5.With the above direction, this Writ Petition is disposed of. No costs. Consequently, connected M.P. is also closed.
