ORDER : The Court Made the following order :- The petitioner, who apprehend arrest for the alleged offences under Sections 149, 366(A) and 506(ii) of IPC and Section 5 (L) and 6(17) of POCSO Act 2012 and Section 9 and 10 of Children Marriage Prohibition Act in Crime No.383 of 2016, on the file of the respondent police, seeks anticipatory bail.

2. Heard both sides.

3. The case of the prosecution is that, the the minor girl Renuka had been abducted by the 1st accused Aravindan who had having love affairs and therefore 1st accused and Renuka had eloped to some other place in order to perform love marriage. Hence, the defacto complainant has lodged a complaint against the petitioner.

4. The learned counsel for the petitioner would submit that the petitioner did not commit any mistake as alleged by the prosecution and hence, he seeks for grant of anticipatory bail.

5. The learned Additional Public Prosecutor appearing for the State would submit that the petitioner is not an accused in this case. Hence, the petition is not maintainable and may be closed. https://hcservices.ecourts.gov.in/hcservices/

6. Taking into consideration the facts and circumstances of the case and also recording the submission made by the learned Additional Public Prosecutor, the criminal Original Petition is closed.
