W.M.P.No.36837 of 2018 in W.P.No.37716 of 2016 S.M.SUBRAMANIAM.J., The Present Miscellaneous Petition is filed to direct the 2nd respondent to refund the amount of Rs.1.5 Lakh deposited by the petitioner on 11.02.2005, 17.03.2005 and 31.01.2017 by virtue of interim conditional orders passed by this Court on 19.01.2005 and 01.11.2016 along with accumulated interest. 2.The learned counsel for the petitioner states that the writ petition was allowed by this Court on 23.08.2018. Thus, the amount deposited by the petitioner is to be repaid. However, the respondents have not taken any action to repay the said amount.

3.The learned counsel appearing on behalf of the respondents states that the Management preferred a Writ Appeal, which is yet to be numbered. However, the clarification as such sought for in the Miscellaneous petition cannot be granted. Such writ petition itself was allowed by this Court and it is left open to the writ petitioner to initiate appropriate proceedings in the manner known to law.

4.Mr.G.Narasimman, MD of the Salem Agricultural Producers Cooperative Marketing Society, Salem present before this Court along with the documents and assisted by the learned counsel for respondent.

5.Further appearance of the respondent is dispensed with. 6.Accordingly, the miscellaneous petition stands dismissed. 11.12.2018 kak/pkn Note:Registry is directed to return the certified copy of the order passed in W.P.No.37716 of 2016 dated 23.08.2018 to the learned counsel for the petitioner.
