C.M.P.No.12013 of 2022 in S.A.No.618 of 2008 C.V.KARTHIKEYAN,J.

This petition had been taken up for consideration today. A perusal of the records show that it had been filed on 27.11.2018 with respect to the death of the sole appellant Jeeva Rekha, who had died on 15.10.2018 and to bring on record her legal representatives /her husband and two sons as appellants 2, 3 & 4.

2.The petition had been filed within the prescribed time and there appears to have been some delay on the part of the Registry to number the same and put up them before this Court.

3.In view of the fact that the second appeal had been admitted and substantial questions of law had been framed, I would allow this petition and direct the appellants to proceed further by advancing argument in the second appeal.
