C.M.P.No.22125 of 2018 in Tr.C.M.P.No.29 of 2018 S.VAIDYANATHAN,J.

The petitioner has come forward to condone the delay of 24 days in filing the restoration application in the above transfer civil miscellaneous petition.

2. When the matter is taken up for hearing, learned counsel for the petitioner submitted that the suit itself has been dismissed as early as on 11.11.2019. The purpose of condoning the delay is not going to help the petitioner in any manner. It is open to the petitioner to challenge the judgment and decree, if he is so advised or to take steps for restoration of the suit.

3. Accordingly, the civil miscellaneous petition is dismissed.
