Mr.K.K.Ramesh Government Advocate (Forests) Prayer : Writ Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing respondents to sanction interest for the belated payment of terminal benefits to the petitioner ie.,Death Cum Retirement Gratuity, arrears of pension, commutation of pension, surrender of earned leave and General Provident Fund, from 01.02.2014 to the date of payment of respective benefits at the rate of 18% as per the honourable Supreme Court of India.

O R D E R

The petitioner retired from service on 31.01.2014. As his retirement benefits were not settled, the petitioner had filed W.P.No.20163 of 2014 and the by virtue of the orders of this Court dated 05.04.2014, the retirement benefits and pension was sanctioned to him. It is the claim of the petitioner that interest has not been paid on the belated payment of retirement benefits and in this regard, he has sent a representation to the respondents on 13.06.2018. 2. Mr.K.K.Ramesh, learned Government Advocate takes notice for the respondents. Heard the learned counsel appearing on either side and perused the materials available on record.

In view of the limited relief sought for, this Court is of the view that it is not necessary to dwell into the merits of the issue, but it would be suffice to direct the respondents to consider the representation and pass orders on merits and in accordance within law, within a limited time frame.

4. In the above circumstances, this writ petition is disposed of directing the respondents to consider the representation dated 13.06.2018 and pass orders on merits and in accordance within law, within a period of eight weeks from the date of receipt of a copy of this order.
