Respondents PRAYER: The Writ Petition has been filed Under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the 2nd respondent/District Collector, Chennai, to consider the representation of the petitioner dated 21.12.2016 and release the land and building situated at Old Door No.200, New Door No.6, Kutchery Road, Mylapore, Chennai - 600 004 from the control of the Accommodation Controller & Rent Controller, (V-Section Tahsildar), Office of the Collector of Chennai No.32, Rajaji Salai, Chennai - 600 001 in favour of the petitioner. The present Writ Petition has been filed for issuance of a Writ of Mandamus to direct the 2nd respondent/District Collector, Chennai, to consider the representation of the petitioner dated 21.12.2016.
2. The learned counsel appearing for the petitioner submitted that the petitioner has made a representation dated 21.12.2016 before the 2nd respondent seeking to release the land and building situated at Old Door No.200, New Door No.6, Kutchery Road, Mylapore, Chennai - 600 004 from the control of the Accommodation Controller & Rent Controller (V-Section Tahsildar), Chennai, in favour of the petitioner, but, the same is yet to be disposed of by the second respondent.
3. Heard Mr.V.Shanmugasundar, Special Government Pleader appearing for the respondents.
4. Considering the facts and circumstances of the case and the submissions made on either side, this Court, without expressing any opinion on the merits of the representation, directs the 2nd respondent/District Collector, Chennai, to consider the petitioner's representation dated 21.12.2016 and pass appropriate orders, on merits and in accordance with law, after issuing notice to the petitioner and the persons interested in this regard and also affording them an opportunity of personal hearing, within a period of four (4) weeks from the date of receipt of a copy of this order.
