Writ petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records in pursuance of order dated 07.11.2018, in Na.Ka.No.3493/2017/Thi2, from the 2nd respondent and quash the same as arbitrary and direct the 2nd respondent to issue license to run a pig farm in Survey No.63/1A, R.Pudupalayam Village, Rasipuram Taluk, Namakkal District.

ORDER

With the consent of either side, the writ petition itself is taken up for final disposal.

2.Challenging the impugned notice dated 07.11.2018, this Writ Petition has been filed before this Court. In the aforesaid notice, the second respondent/Special Officer/Panchayat Executive Officer directed the petitioner to remove the pig farm within ten days, failing which, necessary action will be taken for removal of the pig farm.

3. During the arguments, the learned counsel for the petitioner would submit that subsequently the petitioner made a representation to the second respondent and the said application was rejected. Challenging the aforesaid rejection order, W.P.No.33872 of 2018 has been filed before this court.

4. According to the learned Special Government Pleader, technically the present writ petition is liable to be dismissed on the ground that, challenging the subsequent order passed by the 2nd respondent, another Wit Petition is filed and the same is pending for consideration before this court.

5. Taking note of the above submission, the Writ Petition stands dismissed as infructuous as nothing survives for adjudication in the present writ petition. No costs. Consequently, connected writ miscellaneous petition is also closed.
