PARTHIBAN CRIMINAL MISCELLANEOUS PETITION No.17024 of 2018 IN CRL RC.1186/2018 MOHAMMED ABBAZ @ ABBAZ [ PETITIONER/APPELLANT/ACCUSED] Vs SHYMALA RAJA [ RESPONDENT ] Petition praying that in the circumstances stated therein the High Court will be pleased to extend the time to deposit a sum of Rs.4,00,000/- by another four weeks in the order passed in Crl.MP.No.13953 of 2018 in Crl.RC.No.1186 of 2018 dt.16.10.2018 on the file of this Hon'ble Court.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.T.MURUGANANTHAM, Advocate for the petitioner the court made the following order:- Earlier, this Court vide its order dated 16.10.2018, in Crl.M.P.No.13953 of 2018, suspended the substantive sentence alone on condition that the petitioner shall deposit a sum of Rs.4,00,000/- within a period of four weeks from the date of receipt of a copy of the order to the credit of C.C.No.1554 of 2014 on the file of the learned III Metropolitan Magistrate, George Town, Chennai, failing which, the suspension of substantive sentence of imprisonment granted, shall stand automatically vacated.

2. Now, the petitioner filed this petition to extend the time to deposit a sum of Rs.4,00,000/- as ordered by this Court in Crl.M.P.No.13953 of 2018, dated 16.10.2018.

3. The learned counsel for the petitioner would submit that the petitioner requires short extension of one week time from today for depositing a sum of Rs.4,00,000/-. According to the learned counsel that the amount is ready, but, in view of four weeks time granted by this Court on 16.10.2018, the same could not be deposited.

4. In view of the above submission, this Court feels that the ends of justice would be served by extending the time by one week from today. No further extension of time would be granted. In case, the petitioner fails to deposit the said amount within a period of one week, the suspension of substantive sentence of imprisonment shall stand vacated automatically, without any further reference to https://hcservices.ecourts.gov.in/hcservices/

this Court.
