Petition praying that in the circumstances stated therein the High Court will be pleased to grant the extension of time of two weeks to surrender and comply with the order of the Hon'ble court in Crl.M.P.No.15600/2018 in Crl.OP.No.23575/2018 dated 22.11.2018. Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.P.ARASAN, Advocate for the petitioner and of MRS.PRABHAVATHI, ADDL. PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- Heard both sides.
2. This application is filed to grant extension of time of two weeks to surrender and comply with the order of this Court in Crl.M.P.No.15600 of 2018 in Crl.O.P.No.23575 of 2018 dated 22.11.2018.
3. This Court imposed a condition by an order dated 29.10.2018, thereby, the petitioner shall deposit a sum of Rs.5,00,000/- (Rupees Five Lakhs Only) to the credit of Crime No.232 of 2018 before the learned XVIII Metropolitan Magistrate, Saidapet. This Court already extended time for complying with the condition by its order dated 22.11.2018 in Crl.MP.No.156 00 of 2018. Even then, the petitioner did not comply with the condition. Affidavit filed by the learned counsel for the petitioner states that the petitioner is a daily wages employee and he could be able to mobilize funds to comply with the condition.
4. Considering the facts and circumstances of the case, this Court is inclined to extend time by another two weeks from today to deposit a sum of Rs.5,00,000/- (Rupees Five Lakhs Only) as per the condition imposed by this Court by an order dated 29.10.2018. https://hcservices.ecourts.gov.in/hcservices/
Hereafter, no more extension of time will be granted. If the petitioner fails to comply with the condition, the order granted by this Court in Crl.OP.No.23575 of 2017 dated 29.10.2018 shall stand automatically cancelled.
