PARTHIBAN CRIMINAL MISCELLANEOUS PETITION Nos.16426 & 16427 of 2018 IN CRL.RC.NO.1414/2018 G.VENKATESH [ PETITIONER/APPELLANT/ACCUSED IN BOTH THE PETITIONS] Vs K.MUTHUKUMAR [ RESPONDENT IN BOTH THE PETITIONS] Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Criminal RC No.1414 OF 2018 on the file of the High Court, the High Court will be pleased to
(1) suspend the substantial sentence of imprisonment alone imposed in STC.No.77 of 2012 on 14.02.2017 by the Judicial magistrate, Fast Track Court at Magisterial level-II, Coimbatore and having been modified by the Learned I Additional District and Sessions Judge, Coimbatore on 08.10.2018 in C.A.NO.63 of 2017 and enlarge the petitioner herein on bail pending disposal of the Crl.RC.NO.1414/2018. (CRL.MP.16426/2018)
(2) exempt the petitioner from surrendering before the authorities concerned in STC.No.77 of 2012 on the file of the Judicial Magistrate, Fast Track Court at magisterial Level-II, Coimbatore for the suspension of sentence in this regard pending disposal of the Crl.RC.No.1414/2018. (CRL.MP.16427/2018) Order : These petitions coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.RC.No.1414 of 2018 on the file of the High Court and upon hearing the arguments of M/S.C.S.DHANASEKARAN, Advocate for the petitioner ( IN BOTH THE PETITIONS) the court made the following order:- The sentence passed against the petitioner in STC.No.77 of 2012 dated 14.02.2017, by the learned Judicial Magistrate, Fast Track Court at Magisterial Level-II, Coimbatore and confirmed by the learned I Additional District and Sessions Judge, Coimbatore, in C.A.No.63 of 2017 dated 08.10.2018, be suspended on condition that the petitioner shall deposit a sum of Rs.49,500/- to the credit of the above said Court within a period of four weeks from the date of receipt of a copy of this order.
2. If the deposit is not made within the time stipulated by this Court, the order of suspension of sentence shall stand automatically https://hcservices.ecourts.gov.in/hcservices/
vacated without any further reference to this Court.
3. In view of the suspension of sentence, the petitioner is exempted from surrendering before the learned Judicial Magistrate, Fast Track Court at Magisterial Level-II, Coimbatore.
