Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus to direct the first respondent to pass an order on the basis of the appeal representation made by the petitioner dated 27.08.2018 against the order of the second respondent herein dated 20.02.2018. By consent of the parties, the writ petition is taken up for final disposal.

2.The petitioner is an Ex-Army man. The second respondent vide order dated 20.02.2008, rejected the claim of the petitioner dated 31.08.2017, made against the fourth respondent that by using explosives, the fourth respondent caused damages to the house of the petitioner. The said order was challenged before the first respondent by way of a statutory appeal. The appeal was filed on 27.08.2018. However, follow up action was not taken by the first respondent, resulting in filing this Writ Petition.

3.Considering the limited prayer made by the petitioner, no useful purpose is going to be served seeking counter affidavit from the respondents. Hence, the first respondent is directed to consider and dispose of the appeal filed by the petitioner dated 27.08.2018 on merits and as per law. Such exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order.

4. The Writ Petition is disposed of, with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
