Mr.M.R.Gokulkrishnan Additional Government Pleader for R1 and R2 PRAYER:Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, to call for records pertaining to the order passed by the first respondent herein in G.O.Ms.No.32, Planning, Development and Special Initiatives (S.I) Department dated 17.04.2018 and the show cause notice dated 01.11.2018 issued by the second respondent herein under sub section(2) of section 3 of the Tamil Nadu Acquisition of Land of Industrial Purpose Act, 1997 (Tamil Nadu Act 10 of 1999) insofar as Mylapore Part-I Village, Mylapore Taluk,Chennai District for Corridor 4-05 Alwarpet Metro Station in Block No.34, Survey No.1654/2 (7.0 sq.mt) and in Survey No.1654/8 (307.0 sq.mt) to an total extent of 314 sq.mts. is concerned and quash the same and consequently forbearing the respondents herein from in any way interfering with petitioner's peaceful possession of land in Survey No.1654/2 and Survey No.1654/8 of Mylapore Part-I Village, Mylapore Taluk, Chennai District.

ORDER

This writ petition has been filed challenging the impugned Show Cause Notice of the 2 nd respondent dated 01.11.2018 issued under Section 3(2) of the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997. 2.When the matter was taken up for hearing today, the learned Standing Counsel appearing on behalf of Chennai Metro Rail Limited submitted that pending the writ petition, a Memorandum of Understanding was entered into between the petitioner and the Chennai Metro Rail Limited. The copy of the Memorandum of Understanding dated 29.08.2022 was furnished to the Court. 3.On carefully going through the Memorandum of Understanding, it is seen that the parties have reached an understanding in this case and the terms of agreement has been specifically laid down in the Memorandum of Understanding.

4/6 4.In the light of the above development, recording the Memorandum of Understanding entered into between the parties dated 29.08.2022, this writ petition is disposed of with in the above terms. No Costs. Consequently, connected miscellaneous petition is closed.
