Respondents This case came up for settlement before the Lok Adalat. Mr.M.J.Viyajaragavan, learned counsel for the appellant and the learned counsel for the respondent are present. After mutual discussion and negotiation between both parties they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT As against the claim amount of Rs.7,50,036/- with further interest at 9% per annum, the parties have agreed to settle for a total sum of Rs.7,50,036/- in full quit. A sum of Rs.10,00,000/- has already been deposited to the credit of M.C.O.P.
2. Of the said sum, the claimants would be entitled for a sum of Rs.7,50,036/- to be apportioned equally and the Trial Court shall pay out the same without insisting on any formal permission petition.
3. The balance available amount, including the interest, shall be returned to the appellant insurance Company
4. In view of the same, the Civil Miscellaneous Appeal stands disposed of.

This Lok Adalat award is passed in terms of the above settlement. The full court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu Court Fees and suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 2 r/w 25 of LSA Act 1987 as amended in 1994.
