O R D E R

This Criminal Original Petition has been filed seeking to quash the C.C.No.16524 of 2009, pending on the file of Fast Track III Metropolitan Magistrate Court, Saidapet, Chennai.

2. The petitioner is A3. It is seen that the C.C. is https://hcservices.ecourts.gov.in/hcservices/

pending from the year 2009. Even according to the learned counsel for the petitioner, the case is at the stage of trial, since, A2 is absconding, there is absolutely no progress in the trial. This Court is not inclined to interfere with the proceedings at this stage.

3. The presence of the petitioner shall be dispensed with by the Court below and the petitioner shall be represented by his counsel. The petitioner shall be present before the Court below at the time of questioning under Section 313 of Cr.P.C., and at the time of passing a judgment.

The learned counsel representing the petitioner shall cross examine the witnesses on the same day they are examined in chief. The petitioner shall not dispute the identity of the witnesses.

4. This Criminal Original Petition is disposed of with a direction to the Court below to complete the proceedings in C.C.No.16524 of 2009 on the file of the Fast Track Court III Metropolitan Magistrate, Saidapet, Chennai, within a period of two months from the date of receipt of copy of this order.
