Respondents Prayer:- Writ Petition filed under Article 226 of Constitution of India for
the issuance of Writ of Mandamus, forbearing the 1st and 2nd respondents from issuing the patta in the name of the respondents 3 to 6 or cancelling the patta in the name of the petitioner in respect of the property comprised in Survey No.98/9B T.S.No. 53 Block No.29 Ward No.C situated at Zamin Pallavaram Village, Tambaram Taluk, Kancheepuram District within the Municipal Limits of Pallavaram measuring an extent of about 96 cents.

ORDER
This Writ Petition has been filed seeking a direction to the respondents 1 and 2 not to issue patta in the name of the respondents 3 to 6 or in the alternative, to cancel the patta standing in the name of the petitioner, in respect of the property comprised in Survey No.98/9B, T.S.No.53, Block No.29, Ward No.C, situated at Jamin Pallavaram Village, Tambaram Taluk, Kancheepuram District, to an extent of 96 cents.
2. Heard Mr.S.William, learned counsel appearing for the
petitioner, Mr.N.Naveen Kumar, learned Government Advocate appearing for the respondents 1 & 2, Mr.G.Dilip Kumar, learned counsel appearing for the respondents 3 to 5 and perused the materials available on record.
3. It is seen from the records that, so far, no patta has been issued in favour of the respondents 3 to 6 in respect of the subject land.
4. If at all the respondents 3 to 6 apply for any patta or cancelling the patta issued in favour of the petitioner in respect of the subject property, the respondents 1 and 2 are directed to conduct an enquiry, after giving an opportunity of hearing to the petitioner and the counter parties and pass orders on merits and in accordance with law.
5. With the above direction, this Writ Petition stands disposed of. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
