Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Criminal Appeal No.800/2018 on the file of the High Court, the High Court will be pleased to suspend the sentence of imprisonment imposed in the judgment dated 16.11.2018 in Spl.S.C.No.19 of 2018 on the file of the Special Court for Shceduled Caste and Scheduled Tribes Prevention of Atrocities Act 1989 Principal Sessions Court, Erode and enlarge the petitioner on bail pending disposal of the above Appeal petition.[CRL.MP.16607/2018] Order :This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl. Appeal No.800/2018 on the file of the High Court and upon hearing the arguments of MR.JAYAPRAKASH FOR M/S.M.GURUPRASAD Advocate for the petitioner and of MRS.V.
SARATHA DEVI Government Advocate on behalf of the Respondent the court made the following order:- This miscellaneous petition has been filed seeking to suspend the sentence imposed on the petitioner by judgment dated 16.11.2018 in Spl.S.C.No.19 of 2018 by the learned Special Judge, Special Court for SC/ST (Prevention of Atrocities) Act, 1989 (Principal Sessions Court), Erode, and enlarge the petitioner on bail pending disposal of the above criminal appeal.
2. Heard both sides.
3. Having regard to the facts and circumstances of the case, this miscellaneous petition is allowed and the substantive sentence of imprisonment alone is suspended and the petitioner is released on bail on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Bhavani. trial Court on the first working day of every month at 10.30 a.m until further orders.
