PARTHIBAN CRIMINAL MISCELLANEOUS PETITION Nos.16651 & 16653 of 2018 in CRL.RC.NO.1428/2018 JEGADAM MEERA SAHEB [ PETITIONER/APPELLANT/ACCUSED IN BOTH THE PETITIONS] Vs MR.PALEPU SATYANARAYANA [ RESPONDENT IN BOTH THE PETITIONS] Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Criminal RC No.1428 OF 2018 on the file of the High Court, the High Court will be pleased to
(1) suspend the execution of the sentence passed in STC.No.1355/2011 dated 18.02.2016 by the learned Judicial Magistrate, Yanam, Puducherry which was confirmed by the learned II Addl. Sessions Judge, Puducherry in C.A.No.7/2016 dated 17.01.2018. (CRL.MP.16651/2018)
(2) exempt the petitioner from surrendering on the appellate court Judgment passed in learned II Addl. Sessions Judge, Puducherry in C.A.No.7/2016 dated 17.01.2018 for preferring Criminal revision and suspension of execution petition. (CRL.MP.16653/2018) Order : These petitions coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.RC.No.1428 of 2018 on the file of the High Court and upon hearing the arguments of M/S.CHINNASAMI.V. Advocate for the petitioner ( IN BOTH THE PETITIONS) the court made the following order:- The sentence passed against the petitioner in S.T.C.No.1355 of 2011 dated 18.02.2016, by the learned Judicial Magistrate, Yanam, Puducherry and confirmed by the learned II Additional Sessions Judge, Puducherry, in C.A.No.7 of 2016 dated 17.01.2018, be suspended on condition that the petitioner shall deposit the cheque amount of Rs.1,50,000/- to the credit of the above said Court within a period of four weeks from the date of receipt of a copy of this order.
2. If the deposit is not made within the time stipulated by this Court, the order of suspension of sentence shall stand automatically vacated without any further reference to this Court. https://hcservices.ecourts.gov.in/hcservices/
3. In view of the suspension of sentence, the petitioner is exempted from surrendering before the learned II Additional Sessions Judge, Puducherry.
