(DCB Erode) 3.The Inspector of Police, CBCID, Erode, Erode District. : Respondents PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C. to direct the 1st respondent to conduct enquiry through the 3rd respondent in-regarding with the 2nd respondent investigation made in Cr.No.31 of 2014 on the file of the 2nd respondent and file amended charge sheet before the learned Special Judge, TANPID Court, Coimbatore by including the genuine deposit receipts and include their name in the creditors list so enable them to get their deposit amount from the A-2 and A-3. ORDER

This petition has been filed seeking for a direction to add this petitioner as one of the witnesses/victims on the ground that the petitioner and her husband have also made a deposit of a sum of Rs.1 lakh each in the chit fund conducted by the accused persons.

2.The learned counsel for the petitioner would submit that the petitioner and her husband had also deposited a sum of Rs.1 lakh each and their names have been left out from the list of victims. Therefore, the present petition has been filed. 3.The learned Additional Public Prosecutor on instructions would submit that the case is now pending for trial before the learned Special Judge, TANPID Court, Coimbatore, in C.C. No.3 of 2016. The learned Additional Public Prosecutor would submit that there are totally 185 victims in this case and the total amount of Rs.11,99,65,140/- has been cheated by the accused persons.

4.Liberty is granted to the petitioner to give necessary particulars to the second respondent with regard to the deposit made by the petitioner and her husband. If the second respondent is satisfied with the petitioner and her husband have made deposit in the company and if they are not repaid back, the second respondent police shall take appropriate steps by including this petitioner also as a witness in the case and proceed further in accordance with the law.

5.This Criminal Original Petition is disposed of with the above directions.
