The petitioner has come out with the present civil miscellaneous petition for condoning the delay of 1235 days in filing the CMA SR.No.117734 of 2018.

2.According to the petitioner, he was suffering from severe illness and disability right from the date of accident and also due to want of pecuniary assistance, he could not file the appeal in time. The reason given by the petitioner for condoning the delay in filing the appeal is not valid and sufficient. Hence, the Civil Miscellaneous Petition is dismissed and Civil Miscellaneous Appeal is rejected at the SR stage itself.
