Petition under Article 226 of the Constitution of India praying for issue of a Writ of Mandamus directing respondents 1 and 2 to retrieve the water spread area lands, catchment area and Government lands 1\4

comprised in Survey No. 123 situated at the western side of Nattapandal Eri (a lake), Thiruvannamalai District as encroached by the 4th respondent and other persons by conducting a field survey as specified in the representation dated 23.07.2018 and further to de-silt the encroached land to restore the water catchment area of the lake bed.

(Made by S. Vaidyanathan,J.) The petitioner, who is a permanent resident of Karumarapatti Village and an agriculturis, is dependent on the water from Nattapandal Eri comprised in Survey No. 123, which is the major source of irrigation for farmers of that area. He is aggrieved by the encroachment made by the 4th respondent to an extent of nearly 2 acres of the water catchment area of Nattapandal Eri. Though representations were given by the petitioner with regard to the flagrant violations and encroachments made thereon, no action was taken. Hence, the present writ petition.

There is no representation on behalf of the petitioner. Today, when the matter is taken up for hearing, Mr.A. Selvendran, learned Special Government Pleader appearing for respondents 1 to 3 would submit that for the purpose of cultivation, some of the Government lands had been encroached and after harvest, during summer time, the encroachments have been removed. He would further state that as on date, there are no encroachments.
