PRAYER: Criminal Original Petition filed under Section 482 of the Cr.P.C., to pass Interim Order, pending disposal of the main O.P, directing the respondents:

1. To provide protection to the tenants and occupants of the building complex.

2. To take appropriate action against Landlady and her hooligans for their legal activities.

This petition has been filed seeking to direct the respondent police to provide protection to the tenants and occupants.

It is seen from the records that the landlord tenant dispute between the parties. In this regard, there is also a petition pending before the Rent Control Court in R.C.O.P.No.114 of 2017. The relief of police protection cannot https://hcservices.ecourts.gov.in/hcservices/

be granted by this Court due to the fact that the dispute is pending before the learned Rent Controller. If the petitioners apprehend any illegal action on the part of the landlord in attempting to evict them illegally, the petitioners can approach the Civil Court seeking for injunction. This petition filed directly before this Court is not maintainable. In the result, this Criminal Original Petition is dismissed, by giving liberty to the petitioners to work out their remedy before appropriate Court. Consequently, the connected miscellaneous petition is also closed.
