It was represented for the plaintiff in C.S.No.414 of 2018 that the said suit is laid for bare injunction by the father against his son and grand son and the father has since passed way. C.S.No.290 of 2016 is a larger suit for partition and all the legal heirs of the plaintiff in C.S.No.414 of 2018 are available there. Given the circumstances, C.S.No.414 of 2018 is not pressed.
2.There is nothing to not press the suit since the plaintiff himself has died and the suit itself has abated.
3.The suit stands dismissed as abated.
