Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorari calling for the entire records in C.P.No.92 of 1997 on the file of the 2nd respondent dated 13.02.2014 and quash the same. For Petitioner :

The writ petition is filed challenging the order passed in the computation petition no.92 of 1997.

2. When the matter came up for hearing, the learned counsel appearing for the petitioner has filed a memo that pending the writ petition, the first respondent/workmen has died. Inspite of the best efforts of the petitioner concerned, the legal heirs of the said Laximanan/first respondent could not be traced out. Therefore, presently the writ petition cannot be proceeded with.

3. The learned counsel would further submit that there was also settlement and therefore, the legal heirs are not coming forward any further and the petitioner management could also not trace the legal heirs of the first respondent workmen to implead in the present writ petition. 2/4

4. In view thereof, since the petitioner/management is not in a position to implead the legal heirs of the first respondent/workmen, this writ petition is dismissed, however, with liberty to seek for restoration of the same, if only, any necessity arises.
