Company Application No.738 of 2018 in Company Petition No.57 of 1998 S.VAIDYANATHAN,J.

This Application is filed seeking to appoint Mr.H.Karthik Seshadri, as Advocate on behalf of Administrator and Official Liquidator (Provisional Liquidator) for Maxworth Orchards (India) Limited cases filed and to be filed from now onwards in all Courts including Reference Application filed in Hon'ble Bench in C.A.Nos.470 to 473 of 2007 and to fix remuneration as approved by the Court.

This Court, by an order dated 22.11.2017 in C.A.Nos.818 and 820 of 2017, has permitted the Administrator and the Official Liquidator to appoint Mr.H.Karthik Seshadri, learned counsel as Advocate for the Writ Petition to be filed against the order passed by the DRAT, Chennai on 05.07.2017 in I.A.No.929 of 2014 in M.A.No.191 of 2011. 3.

For the sake of convenience, relevant paragraphs of the Report filed by the learned Official Liquidator, are extracted below: "8.

That it is pertinent to mention that by an order dated 22.11.2017 in C.A.Nos.818 and 820 of 2017, has permitted the Administrator and the Official Liquidator to appoint Mr.H.Karthik Seshadri, Advocate as Advocate for the Writ Petition to be filed against the order passed by the DRAT, Chennai on 05.07.2017 in I.A.No.929 of 2014 in M.A.No.191 of 2011 and liberty was given to the learned Administrator to fix the remuneration as per the fee schedule.

In the on-going situation, the Administrator has filed the present Application for appointment of Shri.H.Karthik Seshadri as Advocate on behalf of Administrator and the Official Liquidator for Maxworth Orchards (India) Limited, cases filed and to be filed hereafter in all Courts including the Application filed before the Hon'ble Division Bench in C.A.Nos.470 to 473 of 2007 and to fix remuneration as approved by this Court." 4.

Taking note of the Report filed by the learned Official Liquidator, this Application is ordered as prayed for. The Administrator is at liberty to fix remuneration for Mr.H.Karthik Seshadri, learned Counsel, as per the Schedule.
