C.M.P Nos.13465, 13466 and 13467 of 2020 in C.M.A.No.161 of 2013 A.A.NAKKIRAN, J.

These three applications have been filed by the petitioner/appellant, i) to condone the delay of 1734 days in filing the petition to set aside the abatement caused due to the death of Muniammal, the 2nd respondent in CMA No.161 of 2013, ii) to set aside the abatement due to the death of Muniammal, the 2nd respondent and iii) to bring on record the proposed respondents 4 and 5 herein as legal representatives of the deceased 2nd respondent Mjniammal and record them as respondents 4 and 5 in C.M.A No.161 of 2013.

2. There is no representation for the 3rd respondent.

3. The learned counsel for the 1st respondent has no objection in allowing these three applications.

4.Being satisfied with the reasons stated in the affidavits filed in support of these petitions, these three petitions are allowed.

5. Registry is directed to carry out necessary amendment and post the matter on 09.01.2023.
