This writ petition has been filed seeking a direction to the respondent to return the original Driving Licence to the petitioner.
2. According to the petitioner, he was a driver in Tamil Nadu State Transport Corporation, Tirupattur Depot. On 18.11.2018, when he was driving the bus from Tirupattur to Narayanapuram Village, the bus met with an accident. Based on that, a criminal case was registered against him by the police in Cr.No.194/2018, under Sections 279 and 337 IPC. Thereafter, the petitioner's licence was seized by the police and the same was handed over to the respondent/Regional Transport Officer for taking action under section 19 of the Motor Vehicles Act. But, so far no action has been taken by the respondent and the https://hcservices.ecourts.gov.in/hcservices/
respondent/Regional Transport Officer is holding the licence with him. Hence, the present writ petition.
3. Today, when the matter came up for hearing, Mr.R.Govindasamy, learned Special Government Pleader, appearing for the respondent, on instructions, submitted that already the respondent has passed an order on 11.01.2019, suspending the petitioner's licence for a period of six months.
4. In view of the fact that already order has been passed by the respondent suspending the petitioner's licence, the relief sought for by the petitioner cannot be granted at this stage. Accordingly, this writ petition is dismissed. However, liberty is given to the petitioner to challenge the order passed by the respondent, in the manner known to law.
