PRAYER: Writ Petition filed under Article 226 of the Constitution of India, for the issuance of Writ of Mandamus, directing the 3rd respondent herein to renew License to the petitioner to store and sell small arms nitro compound (crackers) not exceeding 25 Kilograms for the year 2018-2019 in shop premises bearing Door No.107, Jawaharlal Nehru Street, Tindivanam, Villupuram District in the light of the order passed

O R D E R
This Writ Petition has been filed, seeking for issuance of a Writ of Mandamus, to direct the 3rd respondent herein to renew License to the petitioner to store and sell small arms nitro compound (crackers) not exceeding 25 Kilograms for the year 2018-2019 in shop premises bearing Door No.107, Jawaharlal Nehru Street, Tindivanam, Villupuram District in the light of the order passed by the Special Commissioner of Land Administration dated 22.09.1998 (Appellate Authority Under Explosive Rules 2008).
2. Today, when the matter is taken up for hearing i.e. 14.12.2021, none appeared for the petitioner.
3. However, Mr.M.S.Prem Kumar, learned Government Advocate brought to the knowledge of this Court, that this matter relates to renewal of License for the year 2018-2019 for the purpose of storing and selling small arms nitro compound (crackers) not exceeding 25 kilograms used to be issued every year at the time of Diwali. The present Writ Petition has been filed for new License for the year 2018-2019. Therefore, by efflux of time, the prayer sought for in this writ petition has become infructuous.
4. Probably, this maybe the reason for the petitioner is not showing any interest to prosecute the case.
5. Hence, this writ petition is dismissed for nonprosecution. No costs. Consequently, connected miscellaneous petition is closed.
