Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the respondent to give police protection to the petitioner for survey his land with the help of approved surveyor and fix boundary of his land measuring about 15 cents for the survey No.302/1 situated at 10th Cross Vivekananda Street, Thiru Nagar, Katpadi Taluk, Vellore District. ORDER
This petition has been filed to direct the respondent to give police protection to the petitioner for survey his land with the help of approved surveyor and fix boundary of his land measuring about 15 cents for the survey No.302/1 situated at 10th Cross Vivekananda Street, Thiru Nagar, Katpadi Taluk, Vellore District.
2. The learned counsel for the petitioner would submit that the petitioner submitted his representation dated 08.12.2018 thereby seeking police protection to survey his land with the help of approved surveyor and fix boundary of his land measuring 15 cents for the survey No.302/1 situated at 10th Cross Vivekananda Street, Thiru Nagar, Katpadi Taluk, Vellore District.
3. The learned Additional Public Prosecutor would submit that the representation of the petitioner was enquired and the same was closed as the matter pertaining to civil in nature. https://hcservices.ecourts.gov.in/hcservices/
4. It is seen that the petitioner submitted his representation only to seek police protection while surveying the land with the help of the approved surveyor. Therefore, the revenue authority has to ascertain whether any hindrance while survey the land, and if they found any hindrance to the petitioner from the neighbours to survey the land, they can very well seek police protection to survey the petitioner's land. Therefore, the petitioner is at liberty to approach the revenue authorities for surveying his land. Thereafter, the revenue officials may seek police protection from the respondent if required.
5. With the above observation, this Criminal Original Petition is disposed of.
