Respondents PRAYER Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for the records of the 2nd respondent issued vide proceedings in Na.Ka.No.5304/Ni.1/2013 dated 28.07.2017 and in Na.Ka.No.5304/Ni.1/2014 dated 20.11.2018 and quash the same and consequently direct the respondents herein to cancel the bond by accepting the sum of Rs.10 Lakhs along with interest @6% from the date of such demand to be raised pursuant to the orders to be passed in the disciplinary proceedings against the petitioner. The learned counsel for the writ petitioner though argued the matter elaborately and this Court expressed its opinion that the writ petitioner studied the Post Graduate course as inservice candidate at the cost of the Tax Payers' money and she is bound to pay the Tax Payers' money.
2.The learned Special Government Pleader also submitted certain documents showing that the writ petitioner is practicing privately by running a clinic.
3.At this juncture, the learned counsel for the writ petitioner made a submission that the writ petitioner may be permitted to withdraw the writ petition on condition that she will pay the entire demanded amount by the Government within a period of 4 weeks from the date of receipt of a copy of this order.
4.The demanded amount as per the calculation sheet issued by the Joint Director of Medical and Rural Health Services, Tiruppur, the petitioner is liable to pay a sum of Rs.19,02,706/-.
5.However, the writ petitioner is permitted to withdraw this writ petition in view of the undertaking given by the petitioner to pay the demanded amount of Rs.19,02,706/- within a period of four(4) weeks from the date of receipt of a copy of this order and in respect of the other claims, the respondents are directed to proceed in accordance with law.
