CORAM:

THE HONOURABLE MR.JUSTICE C.T.SELVAM and THE HONOURABLE MRS.JUSTICE R.HEMALATHA H.C.P. No.2951 of 2018 B.Kalai Surekha ... Petitioner/Wife of the Detenue .. Vs ..

1.The Superintendent of Police, Vellore District, Vellore.

2.The Inspector of Police, Thimiri Police Station, Vellore District.

... Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, directing the second respondent herein to produce the petitioner's husband the detenu M.Vinoth, Son of Mahalingam aged about 35 years before this Court and set him at liberty.

For Petitioner :

Mr.T.Muruganantham For Respondents:

Mr.R.Prathap Kumar Additional Public Prosecutor

ORDER

[Order of the Court was made by C.T.SELVAM, J.] Petitioner, who is the wife of the detenu viz., Vinoth, S/o.Mahalingam, aged 35 years, sought production of her husband.

2. We have heard learned counsel for petitioner as also learned Additional Public Prosecutor for respondents. 3.The petitioner has much grievance against her husband and informs that he has cheated her into marrying him, despite his having been earlier married. He has also forged the orders of https://hcservices.ecourts.gov.in/hcservices/

Court towards aiding him in commission of offence against the petitioner.

4. Learned Additional Public Prosecutor submits that the Inspector of Police, All Women Police Station, Ranipet, has registered a case in Crime No.24 of 2018 for the offences under Section 465, 466, 468, 471, 406, 420, 493, 294(b) & 506(i) IPC on the complaint of the petitioner. But on complaint of the petitioner, efforts of such police to trace the accused/alleged detenu in this case have thus proved futile. It is in the interests of respondents to trace the detenu and thus, this Habeas Corpus Petition need not be kept pending. On such reasoning, the petition shall stand closed.
