Respondent(s) PRAYER: Writ Petition is filed under Section 226 of the Constitution of India to the respondent to consider and appoint the petitioner in the post of SubInspector of Police (Technical) pursuant to the Advertisement No.1/2018 dated 11.7.2018 on the basis of the physical measurement and certificate verification conducted on 19.11.2018 under the BC quota and consequently direct the respondent to extend all the benefits thereto.

ORDER

This writ petition has been filed to direct the respondent to consider and appoint the petitioner in the post of Sub-Inspector of Police (Technical) pursuant to the Advertisement No.1/2018 dated 11.7.2018 on the basis of the physical measurement and certificate verification conducted on 19.11.2018 under the BC quota and consequently direct the respondent to extend all the benefits thereto.

2. Ms.K.Keethi, the learned counsel for the petitioner, submitted that the petitioner has been called for physical measurement test and certificate verification but she has not been selected. When the results were published, the petitioner came to know that her name was not found in the list of candidates selected for appointment.

3. Mr.D.Sowmi Datta, the learned Standing counsel for the respondent, submitted that certificate verification and physical measurement is one of the steps in the recruitment process and that alone cannot ensure the appointment unless the petitioner is found to be qualified in all other selection.

4. Despite the petitioner has passed the written examination, she was not called for Viva-voce. Since the cut off of the petitioner did not qualify her to be called for interview, the petitioner could not participate in the further selection process. The petitioner was under a wrong presumption that her appointment will be confirmed just because her certificate verification has been done and she is found to be fit in the physical examination.

5. As the petitioner has filed this writ petition on the wrong construction of Rules without knowing the outcome of the eligibility to be called for vivavoce, the petition is liable to be dismissed.

6. Accordingly, the writ petition is dismissed. No costs. Connected miscellaneous petition is closed.
