Mr.S.V.Vijay Prashanth Additional Government Pleader (Forests) Prayer : Writ Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the respondents to consider the petitioner's representation dated 20.10.2017 for counting the period of training from 01.02.2008 to 31.07.2008 as duty period in the cadre of Forest Range Officer in the light of the Government Letter No.3065/FR2/99-5 dated 05.05.2000 and to revise the petitioner's pension with all consequential benefits within the time frame.
O R D E R
The petitioner joined as Forester by direct recruitment on 17.02.1982. Thereafter, he was promoted as Forest Range Officer on 01.02.2008. He was deputed for training from 01.02.2008 to 31.07.2008. After completion of his training in the Forest Traning College, he was issued with posting order in the third respondent's division and joined on 07.08.2008. The petitioner claims that as per Letter No.3065/FR.2/99-5 dated 05.05.2000, he is eligible to get pay fixation by calculating the training period. Hence, he made a representation on 02.02.2010 to the third respondent to count the period spent on training to fix his pay on the scale of Forest Ranger from 01.02.2008. The said representation was rejected by the third respondent, by his proceedings dated 06.08.2010.
Thereafter, the petitioner submitted another representation to the third respondent on 20.10.2017, stating that the petitioner's claim has to be considered in the light of the Letter No.3065/FR.2/99-5 dated https://hcservices.ecourts.gov.in/hcservices/
05.05.2000. The said representation did not evoke any response and hence the petitioner has filed the present writ petition.
2. Mr.S.V.Vijay Prashanth, learned Additional Government Pleader (Forests) takes notice on behalf of the respondents.
3. Considering the facts and circumstances and the limited scope of the prayer, the respondents are directed to consider the representation of the petitioner dated 20.10.2017 in the light of the Letter No.3065/FR.2/99-5 dated 05.05.2000, and to pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order. The writ petition is ordered accordingly. No costs.
