Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondents herein to consider the representation of the petitioner seeking for upgradation for classes XI and XII without insisting upon DTCP approval for the school buildings and thereby accepting the building permission granted by the Village Panchayat vide Resolution dated 24.3.2004. ORDER
Al Ameen Matriculation School represented by its Correspondent, Valinokkam village, Ramanathapuram District, has come to this Court seeking issuance of a writ of mandamus directing the respondents to consider their representation dated 9.8.2018 seeking upgradation for classes XI and XII without https://hcservices.ecourts.gov.in/hcservices/
insisting upon the DTCP approval for the school building, by accepting the building permission granted by the Village Panchayat vide resolution dated 24.3.2004.
2. Learned counsel for the petitioner submitted that since the school building was built with prior approval from the competent authority prior to 2011 vide the resolution of the panchayat dated 24.3.2004, as the request has been made for upgradation from high school to higher secondary school, the respondents could consider the representation dated 9.8.2018 on the basis of the additional documents produced by the petitioner.
3. The learned Government Advocate, taking notice on behalf of the respondents, submitted that the pending representation of the petitioner would be considered on merits.
4. In view thereof, this Court directs the respondents to consider the pending representation of the petitioner dated 9.8.2018 and pass appropriate orders on merits, within a period of four weeks from the date of receipt of a copy of this order.
