O R D E R

This Transfer Civil Miscellaneous Petition has been filed seeking transfer of H.M.O.P.No.402 of 2018 pending on the file of the Family Court, Coimbatore to the file of Family Court, Thiruchirappalli.

2. Respondent and Petitioner are husband and wife. Respondent/husband filed petition for divorce in H.M.O.P.No.402 of 2018 on the file of Family Court, Coimbatore.

3. Despite service of notice, the respondent/husband has not chosen to appear before this Court.

4. From the pleadings, it is seen that the petitioner/wife is a resident of Trichy. She delivered a male baby in the year 2018. Hence, she finds it difficult to travel a distance of 200kms from Thiruvanaikal to Coimbatore for every hearing before the Family Court at Coimbatore. It will cause physical and financial hardship to the petitioner/wife.

5. Considering the convenience of the parties as well as the physical and financial hardship caused to the petitioner/wife and the child, this Court is inclined to transfer the divorce petition pending before the Family Court, Coimbatore to the file of Family Court, Thiruchirappali.

6. Accordingly, HMOP.No.402/2018 pending on the file of Family Court, Coimbatore is withdrawn and transferred to the file of Family Court, Thiruchirappali.
