PRAYER: Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to issue direction to the respondents to give police protection for smooth and convenient enjoyment of petitioner's properties measuring an extent of 0.50 cents, 0.03 cents out of the total extent of 0.23.5 Acres and 0.11 cents out of 0.23.5 Acres bearing survey numbers. 199/3C, 199/3E and 199/3F respectively, Andimadam village, Ariyalur District as per the interim injunction order dated 16.04.2018 made in I.A.No.454 of 2018 in O.S.No/110 of 2018 passed by the learned Munsif Court, Jeyankondam.

ORDER

This Criminal Original Petition has been filed seeking for police protection.

2. The petitioner has already filed a suit in O.S.No.110 of 2018 and has obtained order of interim injunction in I.A.No.454 of 2018, before the learned District Munsif court, Jeyankondam. In spite of the order of injunction passed by the Court below, there is interference and threat caused to the petitioner. The petitioner has to necessarily workout his remedy before the https://hcservices.ecourts.gov.in/hcservices/

Court below in the pending suit. The respondent police cannot interfere in a dispute of this nature.

3. This Criminal Original Petition is disposed of, by giving liberty to the petitioner to workout his remedy in the pending suit.
