O R D E R

This petition has been filed seeking to quash the proceedings in Crime No.50 of 2018.

2. The allegation that has been made in the complaint is that the petitioner had induced the defacto complainant to sell his property on the promise that he will be made as an partner in his shipping business and no amount was paid towards sale consideration. Subsequently, since the defacto complainant was not made as a partner, the complaint has been given against the petitioner and the respondent police have registered an FIR for an alleged offence under Sections 420 and 423 of IPC.

3. It is seen that the entire sale consideration of Rs.49,00,000/- is said to have been paid by way of cash. This has to be investigated by the respondent police in order to see if this amount was actually paid by the de facto complainant. This Court is not inclined to interfere with the investigation at this stage.

In the result, this Criminal Original Petition is dismissed and the first respondent is directed to complete the investigation in Cr.No.50 of 2018, within a period of three months from the date of receipt of copy of this order. Consequently, the connected miscellaneous petitions are closed.
