Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for issuance of Writ of Certiorarified Mandamus, calling for the records of the respondents with respect to the impugned Notification published in Official Gazette of India on 14th October 2017 in Part II Section 3 and Sub clause (ii) as Notification No.41 as per Section 6 clause (1) of the Petroleum and Minerals Pipelines (Acquisition of Right of User Land) Act, 1962 and quash the same to the extent of the petitioners' Land and consequently, direct the respondent Nos. 1 to 3 to outright purchase of the land forming part of the rerouted pipeline expressly agreed by the respondent No.3.

ORDER

This Writ Petition has been filed challenging the notification dated 14.10.2017 issued for acquisition of land under the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962. 2.Heard the learned counsel appearing on either side and perused the materials available on record.

3. The land in question has now been identified as the same land mentioned in the notification and the land which was acquired. Therefore, the petitioners have now restricted his prayer to the limited extent of seeking compensation in accordance with law. 4.In view of the above, the second and third respondents are directed to determine the value of the land, which was already acquired from the petitioners, and disburse the compensation within a period of twelve weeks from the date of receipt of a copy of this order. 5.With the above direction, this Writ Petition stands disposed of. Consequently, connected miscellaneous petitions are closed. No costs.
