Mr.L.P.Shanmugasundaram, Special Government Pleader Prayer : Writ Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the second respondent herein to appoint the petitioner in suitable post under the fourth respondent society under the compassionate appointment based upon the petitioner's representation dated 26.09.2018.
O R D E R
This writ petition has been filed seeking direction to the respondents to consider the representation of the petitioner dated 26.09.2018, requesting for compassionate appointment. The petitioner's father Subramanian, who was working in the fourth respondent Society, died in harness on 30.07.2017, leaving behind the petitioner's mother, the petitioner and other legal representatives. After obtaining "No Objection Certificate" from all the legal heirs of the petitioner's family, the petitioner made an application on 21.08.2017 to the fourth respondent seeking compassionate appointment. The fourth respondent passed a resolution dated 09.11.2017, to appoint the petitioner as https://hcservices.ecourts.gov.in/hcservices/
Salesman in the Society and forwarded the same to the second respondent. As the petitioner did not receive any further orders, he sent another representation on 26.08.2018, which did not evoke any response and hence he has filed the present writ petition seeking appropriate relief.
2. Mr. L.P.Shanmugasundaram, learned Special Government Pleader takes notice for the respondents. Heard the learned counsel appearing on either side and perused the materials available on record.
3. In view of the limited relief sought for, this Court is of the view that it is not necessary to dwell into the merits of the issue, but it would be suffice to direct the respondents to consider the representation of the petitioner and pass orders on the same within a particular time frame.
4. In the above circumstances, this writ petition is disposed of directing the second respondent to consider the representation of the petitioner dated 26.09.2018 in the light of the resolution of the fourth respondent dated 30.10.2017 and pass orders thereon, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. No costs.
