(FTC) Thiruchengode U/s.138 of the Negotiable Instrument Act in STC No.135 of 2012 dated 28.03.2018 and confirmed by the Session.(Fast Track Mahila) Judge in Crl.A.No.40 of 2018 dated 29.08.2018 and enlarge the petitioner on bail, pending disposal of the above revision.[CRL MP.NO.
17918/2018] Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.Revision Case No.1526/2018 on the file of the High Court and upon hearing the arguments of M/S.M.ABDUL RAZACK Advocate for the petitioner the court made the following order:- This miscellaneous petition has been filed seeking to suspend the sentence imposed on the petitioner by judgment dated 28.03.2018 in S.T.C.No.135 of 2012 on the file of the Judicial Magistrate, Fast Track Court, Thiruchengode and confirmed by the Session(Fast Track Court Mahila) Judge in Criminal Appeal No.40 of 2018 dated 29.08.2018 and enlarge the petitioner on bail pending disposal of the above Criminal Revision.
2. Heard both sides.
3. Having regard to the facts and circumstances of the case, this miscellaneous petition is ordered and the substantive sentence of imprisonment alone is suspended on condition that the petitioner shall deposit 50% of the cheque amount to the credit of S.T.C.No.135 of 2012 on the file of the Judicial Magistrate, Fast Track Court, Thiruchengode, within a period of four weeks from the date of receipt of a copy of this order. Further the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the Judicial
Magistrate, Fast Track Court, Thiruchengode, and the petitioner shall appear before the trial Court on the 1st working day of every English calender month @ 10.30 a.m. until further orders. In case any of the conditions are not complied with, the interim order of suspension shall stand vacated automatically without further reference to this Court.
