PRAYER:

Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the 7th respondent to remove the illegal entries made in the Survey Register in Old Survey No.352/25, Ward C, Block 12, T.S.No.89/1, 89/3, Namakkal Town, consequentially restraining the respondents or their men or agents or any one claiming under them from in any manner interfering with the peaceful possession of the petitioner in New Door No.52, Old No.26C, North 1st Street, S.P.Pudur, Namakkal Town.

ORDER

Heard the learned counsel for the petitioner, the learned Government Advocate appearing for the respondents 1 and 3 to 7, and the learned Standing Counsel for the 2nd respondent.

2. It is represented that the connected Writ Petition with the same prayer was rejected by this Court on 28.04.2014 in W.P.No.25598 of 2008. This Court while disposing of the said Writ Petition has observed as follows:

"4.Therefore, this Court finding that the claim made by the petitioner has been opposed by the respondents herein, as above, this Court is not inclined to entertain the writ petition and is of the view that he has to approach the appropriate Civil Court. In fact, the petitioner has also mentioned in paragraph 5 of the affidavit, filed in support of the petition, that he has already filed a Civil Suit in O.S.No.69 of 2009 on the file of the District Munsif Court, Namakkal and the same is also pending. In view of that, this Court is not inclined to entertain a parallel proceedings.

5. Accordingly, this writ petition is dismissed. Consequently, the connected M.Ps. are closed. No costs."

3. This Writ Petition is also dismissed with the same directions as quoted above. No costs. Consequently, connected miscellaneous petition is closed.
