ORDER

Heard Mr.T.P.Sekar, learned counsel for the petitioner, Mr.R.Vijayakumar, learned Additional Government Pleader appearing for the first respondent, Mr.R.M.Muthukumar, learned counsel for R2 and Mr.Y.Mohan Raj, learned counsel for R3 and R4.

2.The petitioner seeks for issuance of writ of mandamus directing the first respondent to consider the petitioner's representation dated 25.06.2013 and to initiate necessary proceedings against respondents 3 to 5.

3.The case of the petitioner is that respondents 3 to 5 have committed certain irregularities in the management of Village Panchayat and misappropriated Village Panchayat fund more than one crore for the past two years. They have not collected the house taxes from the owners of house situated at SR Kandigai Village Panchayat and they have not collected the building tax from St.Marrys School. But they collected the amount out of record. In this regard, representation was given by the petitioner to take action against them. As the representation has not been considered and no order has been passed by the authorities till date, the petitioner is before this Court.

4.Learned Government Advocate would submit that the matter is in progress and appropriate orders will be passed by the first respondent.

5.Accordingly the writ petition is disposed of directing the first respondent to consider the petitioner's representation dated 25.06.2013 and to pass orders on merits and in accordance with law, after notice to the petitioner and the respondents 3 to 5, within a period of three months from the date of receipt of a copy of this order, after giving notice to the petitioner.
