O R D E R
[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the first respondent in No. RO/TRY/626/2025-CA dated 29.11.2025 and direct the first respondent to grant 28 days ordinary leave without police escort to the petitioner namely Thambuswamy, S/o.Raju aged about 70 years, Life convict prisoner PID No.355718, confined at Central Prison, Trichy.
2. It is the case of the petitioner that he was convicted by the learned Additional Sessions Judge, A&N Islands, Port Blair in S.C. No.60 of 2010 on 22.02.2012 and sentenced to undergo life imprisonment for the offence under Section 302 of IPC. Aggrieved over the same, he has filed an appeal before the High Court at Calcutta in Crl.A.014 of 2014 and the same was dismissed by the Court on 20.01.2014. The petitioner submitted an application
seeking ordinary leave for a period of 28 days. After considering the request made by the petitioner, the first respondent granted ordinary leave to the petitioner with escort. The petitioner, being a poor person, could not afford the cost of escort.
3. In view of the above, the condition imposed in the order dated 29.11.2025 directing the petitioner to go on ordinary leave with escort is modified and he shall go on ordinary leave without escort. However, the petitioner is directed to comply with the usual conditions imposed by the jail authorities and he should also report before the fourth respondent police daily at 05.30 p.m. He shall duly comply with the conditions and return to the prison on expiry of the leave period.
4. Accordingly, the order of the first respondent dated 29.11.2025 is quashed in sofar as the ordering escort alone and the Writ Petition is disposed of.
