Prayer: Appeal suit filed under section 96 of the Civil Procedure Code, against the judgment and decree, dated 19.07.2016 passed in O.S.No.204 of 2015 on the file of the I Additional District Judge, Madurai.

DECREE:This Appeal coming on for hearing in the presence of Mr.V.Santhakumaresan, Advocate for the Appellant and of Mr.T.R.Jeyapalam, Advocate for the Respondents and the parties herein jointly settled the matter and jointly entered into a joint Compromise between themselves and having filed into the Court a joint memo of compromise duly signed by the parties herein and by their respective Advocates and upon perusing the grounds of Appeal the order of the Lower Court and the material papers in the Suit and this Court while disposing of the Appeal doth record the joint memo of compromise dated 06.11.2017 the original which is annexed herein doth in terms thereof order and decree as follows:- 1.that as per the Joint Memorandum of Compromise, item 1 of the suit properties is situated at Door No.14, Subburaya Vathiyar Lane, South Veli Street, Madurai Town and measures 672 square feet;

2.that as per the Joint Memorandum of Compromise, item 2 of the suit properties is situated at Door No.9, Subburaya Vathiyar Lane, South Veli Street, Madurai Town and measures 315 square feet;

3.that as per the Joint Memorandum of Compromise, both parties hereby agree that item 1 of the suit properties measuring 672 square feet shall be allotted to the 4/5 share of the respondents jointly;

4.that as per the Joint Memorandum of Compromise both parties hereby agree that item 2 of the suit properties measuring 315 https://hcservices.ecourts.gov.in/hcservices/

square feet shall be allotted to the 1/5 share of the appellant; 5.that as per the Joint Memorandum of compromise both parties agree that the appellant shall pay a sum of Rs.1,00,000/- (Rupees One Lakh only) to the first respondent within one month towards owelty;

6.that as per the Joint Memorandum of Compromise, both parties agree that the respondents do not have any right, title or interest over the item 2 of the suit properties; 7.that as per the Joint Memorandum of Compromise, both parties agree that the appellant does not have any right title or interest over the item 1 of the suit properties;

8.that as per the Joint Memorandum of compromise both parties agree that the two sketches drawn in respect of the two schedule of properties shall form part of the compromise memo; 9.that as per the Joint Memorandum of Compromise, decree passed in items of the compromise memo along with the annexed sketches shall be registered by the Joint Sub Register No.1, Madurai south; and 10.that there be no order as to costs in this appeal.
