ORDER
Heard Ms.S.Mahalakshmi, learned counsel on record for writ petitioner. Mrs.J.Padhmaavathi Devi, learned Special Government Pleader accepts notice on behalf of official respondents 1,2 and 3.
The writ petitioner states that he has given a complaint against the fourth respondent (private respondent), who is serving as Marker in the Virudhunagar District Sports Stadium, It is the case of the writ petitioner that official respondents have not taken action on the complaint given by the writ petitioner. I am informed that respondent No.3 is the authority who is to take action.
Be that as it may, learned Special Government Pleader apprises the Court that proceedings have already been initiated by second respondent District Collector against private respondent No.4 vide proceedings bearing reference No.Na.Ka.C3/1768/2018 dated 08.02.2018.
Learned State Counsel also apprises this Court that proceedings initiated are underway and that they will be carried out to its logical end.
I make it clear that this court does not express any opinion whatsoever on the merits of the complaint or respondent No.4.
To be noted, though proceedings had been initiated by respondent No.2 District Collector, it was submitted before this court that it would be desirable if respondent No.1 is directed to conduct the enquiry. Learned State counsel very fairly submits that there is no impediment in giving a direction to respondent No.1 in this regard.
Considering the scope of this writ petition, it will suffice to direct respondent No.1 Member Secretary, Sports Development Authority Tamil Nadu, Chennai to complete the enquiry commenced vide proceedings set out supra, within four weeks from the date of receipt of copy of this order.
A copy of this order shall be communicated by the Registry to respondent No.4, private respondent, within next three working days.
To be noted, this order is passed in the light of the court being apprised that proceedings have already been initiated. This order will not come in the way of the authorities giving all opportunities required in law to be given to respondent No.4 in the proceedings that has been initiated.
