Respondent / Respondent Criminal Miscellaneous Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to grant an exemption exempting the Petitioners from undergoing the sentence imposed by the V-Additional District and Sessions Court,Madurai in Crl.A.No.127 of 2019 dt.16.11.2023 confirming the conviction and sentence imposed by the Learned Judicial Magistrate No.III (CCIW) in C.C.No.78 of 2012 dated 03.10.2019 and pending disposal of criminal revision case.

dt.16.11.2023 confirming the conviction and sentence imposed by the Learned Judicial Magistrate-III(CCIW),Madurai in C.C.No.78 of 2012 dated 03.10.2019 and set aside the same.

Order : This criminal miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/s.T.LENINKUMAR, Advocate for the petitioners and of Mr.A.THIRUVADI KUMAR, Additional Public Prosecutor on behalf of the Respondent, while admitting the criminal revision case, the court made the following order:- The Revision Petitioners seeks exemption from surrender. 2.Considering the nature of the case and the concurrent findings of the Courts below, this Court is of the opinion that in order to afford an opportunity for the revision petitioners to settle the dispute, the petitioners are exempted from surrender.
