RESPONDENT/ RESPONDENT Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to stay the operation of the Judgment and Decree dated 29.01.2018 passed in AS No.82 of 2017 on the file of the 1st Additional District Court, Tirunelveli pending disposal of the above Second Appeal and thus render justice.

Prayer in SA(MD). 17/ 2019 :

Pleased to set aside the Judgment and Decree dated 29.01.2018 passed in AS No.82 of 2017 on the file of the 1st Additional District Court, Tirunelveli reversing the Judgment and Decree dated 18.11.2016 passed in OS No.95 of 2014 on the file of the Subordinate Judge, Ambasamudram and pass such further or other orders as this Hon'ble Court may deem fit and proper in the circumstances of this case and thus render justice.

ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.G.PRABHU RAJADURAI, Advocate for the petitioner and of Mr.M.P.SENTHIL, Advocate on behalf of the Respondent, While admitting the SA, the court made the following order:- Learned counsel for the petitioner seeks permission of this Court to withdraw this petition and he has also made an endorsement to that effect.

In view of the above submission and the endorsement so made, this petition is dismissed as withdrawn.
