Common Prayer: Civil Miscellaneous Appeals - filed under Section 39 of the Special Marriage Act, 1954 to set aside the fair and decreetal order dated 11.04.2017 made in S.M.O.P.No.2 and 3 of 2016, on the file of the Family Court, Dindigul. For Appellant : Mr.A.John Vincent For Respondent : Mr.R.Pon Karthikeyan ( in both appeals) COMMON JUDGMENT (Judgment of this Court was made by K.KALYANASUNDARAM, J.) The civil miscellaneous appeals have been filed to set aside the fair and decreetal order dated 11.04.2017 made in S.M.O.P.No.2 and 3 of 2016, on the file of the Family Court, Dindigul.

2. Heard Mr.A.John Vincent, learned counsel for the appellant and Mr.R.Pon Karthikeyan, learned counsel for the respondent and perused the records.

3. Both parties are present before this Court along with their respective counsels.

4. It is represented by the learned counsel on both sides that the dispute between the parties have been amicably settled and they have filed a joint compromise memo dated 18.12.2017 signed by both parties and the counsel on both sides before this Court.

5. The joint compromise memo is extracted as follows: "(a) both of them are withdrawing their allegations

against each other in the petitions filed before the Family Court, Dindigul.

(b) Both the parties are relinquish their right to demand any compensation, maintenance or permanent alimony from each other.

(c) The respondent agreed not to insist his demand of restitution and agreed to give divorce to the appellant and the appellant agreed not to pursue any litigation in future for maintenance or for share in property.

(d) It is agreed by both the appellant and respondent that they have to decide their future according to their will and convenience independent of each other."

6. In view of the above, the Civil Miscellaneous Appeals are disposed of in terms of Joint compromise memo and the joint compromise memo shall form part of the decree. No costs. Sd/- Assistant Registrar (CO) /True copy/ Sub Assistant Registrar To The Judge, Family Court, Dindigul.
