Civil Miscellaneous Appeals - filed under Section 39 of the Special Marriage Act, 1954 against the decreetal order of the Judge, Family Court, Dindigul dated 11.04.2017 made in S.M.O.P.No.3 of 2016 DECREE: This Civil Miscellaneous Appeal coming on for hearing on this day upon perusing the grounds of Appeal, the order of the Lower Court, and upon hearing the arguments of Mr.A.John Vincent, advocate for the appellant and of Mr.R.Ponkarthikeyan, Advocate for the respondent, and the parties having settled their differences between themselves, and through the respective advocates and having filed the Joint Memo of compromise in to the Court, and signed by both parties as well as by the advocates on either side requesting the Court to pass a decree in terms there of and the memo of compromise the original of which is affirmed and annexed herewith this Court while recording the said memo of compromise as part of this Decree doth order and decree as follows:
1.That both of them be and are hereby agreed to withdraw their allegations against each other in the petitions filed before the Family Court at Dindigul.
2.That both parties be and are hereby agreed to relinquish their right to demand any compensation, maintenance or permanent alimony from each other.
3.That the respondent be and is hereby agreed no to insist his demand of restitution of conjugal rights and agreed to give divorce to the appellant and appellant agreed not to pursue any litigation in future for maintenance or for share in property. https://hcservices.ecourts.gov.in/hcservices/ 4.That both Appellant and Respondent be and are hereby greed that they have to decide their own future according to their will
and convenience, independent of each other.
