Today, when the matter is taken up for hearing, the learned counsel for the appellant would submit that the claim has been settled in the trial Court in E.P.No.61 of 2016 for Rs.11,75,000/- as full quit. So, nothing survives in the appeal and hence, he seeks permission to withdraw the appeal. He has also made an endorsement to that effect.
2.Recording the endorsement made by the learned counsel for the appellant, this Civil Miscellaneous Appeal is dismissed as withdrawn. No costs. Consequently, the connected miscellaneous petition is closed.
